Christian Louboutin wants to trademark his famous red soles and sue Oh, Deer!

While a flash of red on the sole of your shoe used to mean one thing only - a pair of fabulous Louboutins - it could now signal one of many brands, with Oh, Deer!, Steve Madden and even New Look shamelessly turning all their soles red. Now, though, enough is enough: Mr Louboutin has apparently "seen red" himself (sorry, it had to be done) over the copycats, and has filed a trademark application to make those red soles his and his alone. Well, what took you so long, Louboutin?

The main subject of the designer's wrath is Oh, Deer!, which, as Catwalk Queen reported earlier this week, is currently being sued by Louboutin. If I was Steve Madden, I think I'd probably be worried around about now, too...

What does everyone think about this? Does Louboutin have the right to trademark red soles on shoes, or do you think it's fair game for other designers to adopt the trend?

he totally has the right! i agree with the 'what took you so long?' comment! i mean, no one really ever did red soles until he did so it's not that theyre trying to spice their shoes up, theyre just blatantly copying him. at least pick a different colour! blue, green purple, gold even! i mean, seriously.

I agree that they are copying him....but Louboutin should've TM'd sooner (before people started copying him). He's always had the red soles and should've known that as a unique and original idea of his, it should be trademarked from the start.

I totally agree that this is the right action to take, other designers need to stop pretending to be him. There are so many other colors out there those designers can use.
For instance, I bought a pair of pumps that are black patent with a swarovski crystal studded heel, a la the Louboutins I covet. (I am a lover of all things shiny and sparkly.) What I like about them is the have a pink sole, which makes the shoe kind of feel like an ode to Christian Louboutin and not blatant copying.

He should've TM-ed it sooner. This way, Mr. Louboutin would just seem childish. Although, IMO he has every right to do so. Red-soled heels should be strictly Louboutin's.

I wouldn't mind having a pink-soled pair of heels, though :)

As others have said, he should have trademarked it much sooner, before the copycats. I'd be surprised if he managed to get the trademark now when so many are copying it. Does he have the right to sue? Morally/ethically, sure. Legally, well he dropped the ball with the trademarking so the lawyers will have to sort that out.

*would like some shoes with lovely cobalt blue/indigo sole herself*

I have a few pairs of Cesare Paciotti with red soles. They are at least a year old.
